Terms & Conditions
The rules that apply when you use MIPACE, manage profiles or purchase a device.
About these terms
These terms apply when you browse MIPACE, create or manage an account, use a profile or MIPACE device, or buy from the MIPACE store. By using the service, you agree to follow them. If you manage a profile for somebody else or use MIPACE for an organisation, you must also comply with the responsibilities below. Your statutory consumer rights are not affected.
What MIPACE provides
MIPACE is an information-access and communication-support platform. It lets an account holder create controlled profiles, choose what information to make visible and connect those profiles to compatible MIPACE devices. MIPACE is not an emergency service, medical record, medical device, diagnostic tool, item of personal protective equipment or replacement for professional judgement.
MIPACE supports access to information; it does not guarantee a particular safety, medical, safeguarding or emergency outcome. It must not replace calling 999 when appropriate, professional medical advice, first aid, supervision, safeguarding arrangements, workplace procedures, risk assessments or an organisation’s emergency planning.
Accounts, profiles and devices
When a device is purchased, it is assigned to the purchaser’s account in a pending state. After it arrives, the account holder activates it in My MIPACE. Once active, it can be renamed, linked to the appropriate profile, reassigned where available, or reported lost or stolen.
You are responsible for keeping sign-in details secure, choosing the correct profile and visibility settings, reviewing the public view, testing that each device opens the intended profile, and keeping visible information and emergency contacts accurate, current, relevant and proportionate. You must report a lost or stolen device promptly and identify the correct device when doing so.
Information you choose to share
You decide what information is entered and made visible through a profile. Someone with physical access to an active device may be able to open the information you have chosen to share. Temporary links, time limits, access records and other safeguards reduce risk but cannot guarantee that an authorised viewer will not photograph, copy, remember or otherwise record information while it is visible. Only publish information you are comfortable making available for the intended purpose.
Safe placement and use of devices
You are responsible for deciding whether and where a MIPACE device is suitable, following any product and equipment manufacturer instructions and carrying out any assessment required for your circumstances. A device must not obscure safety markings or interfere with a helmet, personal protective equipment, mobility aid, medical equipment, machinery, vehicle control or any other safety-critical item. MIPACE does not inspect, approve or certify an individual installation or placement.
Responsibilities of organisations
An organisation using or supplying MIPACE remains responsible for its own data-protection, safeguarding, health and safety, employment and sector-specific duties. This includes deciding who may create, access or manage profiles; obtaining appropriate authority or consent; training relevant people; keeping assignment records accurate; managing devices and staff access; and maintaining suitable supervision, risk assessments, first-aid arrangements and emergency procedures. MIPACE supplements those arrangements and does not replace them.
Access and third-party response
We do not guarantee that a device will be noticed or tapped, that a phone will have compatible and enabled NFC, that internet access will be available, that information will be read or understood, that an emergency contact will answer, or that a viewer will take a particular action. First aiders, carers, organisations, members of the public, emergency services and other responders must use their own training, procedures and professional judgement. MIPACE is not responsible for their independent acts, omissions or interpretation of user-provided information.
Acceptable use and your content
Do not use MIPACE unlawfully, impersonate another person, upload content you have no right to use, attempt unauthorised access, interfere with security, or use a profile or device to harm, mislead or harass. You remain responsible for content you add and for the consequences of inaccurate, outdated, excessive or unlawfully shared content. You grant MIPACE the limited permission needed to store, protect, process and display that content as you direct.
Orders, payment and delivery
Prices, taxes and available delivery services are shown before an order is placed. The standard MIPACE platform has no monthly or annual subscription charge. We will clearly describe and obtain your agreement before charging for any separately offered optional paid service. An order is accepted when we confirm acceptance or dispatch. Delivery estimates are not guarantees. Please read our Delivery Policy and Returns & Refunds Policy.
Availability and changes
NFC performance, internet access, mobile devices, browsers and third-party services can vary. We do not promise that the service will always be uninterrupted, error-free or compatible with every phone or network. We may maintain, secure, improve or change the service and aim to give reasonable notice of a material change where practical. We may restrict or suspend access where reasonably necessary for maintenance, security, legal compliance, suspected misuse or non-payment for an applicable paid order.
Responsibility and liability
Nothing in these terms excludes or restricts liability where doing so would be unlawful. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and the statutory rights and remedies available to consumers. MIPACE remains responsible for providing its service with the care and skill required by law.
Subject to those protections, MIPACE is not responsible for loss or harm caused by inaccurate, incomplete or outdated user-provided information; a user’s choice of what to publish; unauthorised or unsuitable profile management; unsafe device placement; failure to follow instructions; misuse; a lost device not being reported promptly; unavailable connectivity; an incompatible or incorrectly configured phone; independent acts or omissions of a viewer or responder; or events outside our reasonable control.
Nothing in these terms makes MIPACE responsible for duties that legally remain with a parent, guardian, carer, employer, organisation, equipment owner, first aider or professional responder. This section does not reduce any responsibility MIPACE has under applicable product-safety, data-protection, consumer or other mandatory law.
